    摘要:

    企业群体劳动争议数量逐年上升,而我国对群体劳动争议的名称、法律规定、行为结果乃至预 防制度大都模糊不清。针对劳动关系市场化进程中日益激烈的劳资矛盾,集体协商机制的健全愈发显得有效而 重要。观察我国几项典型群体劳动争议的前因后果,研究企业、劳动者、社会共存共亡的发展规律,重新构建 集体协商谈判机制、完善工会权责制度、用法律手段处理群体劳动争议,以降低其负面影响的长效机制显得尤 为必要。

    Abstract:

    The number of labor disputes in enterprise group rises annually, whereas the name, legal stipulation, behavior result and prevention system of the labor dispute in our country are mostly vague. Aiming at the increasingly intense labor conflicts in the process of marketization of labor relations, the perfection of collective bargaining mechanism becomes more effective and more important. By observing the causes and consequences of several typical group labor disputes in China, it is particularly necessary to study the development law of enterprises, laborers and social coexistence and to reconstruct the mechanism of collective bargaining and negotiation, perfect the system of labor and responsibility of trade unions, and deal with the work disputes by law means to reduce their negative effects.
