上海市欠薪保障金制度：现状和前景

A Study on the Current Status and Prospects of Shanghai's Wage Security System

摘要:

建立欠薪保障金是帮助劳动者解决因企业欠薪引起的临时性生活困难、维护社会稳定的重要举措。虽然一直在争议中前行，但上海欠薪保障金运行良好。自欠薪保障金建立以来，上海没有发生因欠薪引发的重大社会事件。尽管不能从源头上避免欠薪问题的发生，但欠薪保障金是化解欠薪矛盾的有效法律手段。为更好地发挥其作用，上海欠薪保障金制度还有必要在设立独立的欠薪保障基金委员会、处理好与工资保证金制度的关系、工会参与以及立法权限等方面作进一步的考虑和改善。

Abstract:

The establishment of wage arrears is an important measureto help workers solve their temporary life difficulties caused by corporate wage arrears,and maintain social stability.Although it has been movingforward in controversy,the Shanghai wage security fund is working well. Since the establishment of the fund,there have been no major social incidents caused by wage arrears in Shanghai.Althoughtheproblemofwage arrears cannot be avoided from thesource,the wage arrears protection fundistheeffectivelegalmeanstoresclve the contradiction in wage arrears. To better play its role,the Shanghai wage security fund system also needs tofurtherconsiderandimproveitsftmctions in aspects of establishing an independent wage security fund committee,handling the relationship withthe wage guarantee system,union participation and legislative authority.
