Abstract:With the advent of flexible employment model of the Internet, the protection of rights and interests of takeaway riders, such as their medical care, work-related injuries, and pensions, have aroused great attention from the society. This study, based on the internal and external empirical surveys of flexible employment management of the Internet food delivery platfonns of relevant entities, puts forward an improvement path to solving problems of protection of the rights and interests of flexible employment groups on the Internet. The study finds that the root cause of insufficient protection of riders' rights and interests lies in the insufficient supply of external systems, which reflects in the difficulties in system connection caused by the vague supply of basic legislation of the legal relationship and labor standards of riders, the difficulty in system implementation caused by the 如lure to establish industry standards and industry associations, the difficulty of system sinking caused by contradictions between the point distribution of riders and the organizational management of groups, and the system popularization difficulty caused by contradictions between the locality of government governance and the globalization of platform governance. To increase the effective supply of the protection system of the riders' rights and interests, the study suggests that it is necessary to break the internal and external constraints by using the comprehensive thinking and improve the system continual self-consistency, fair self-consistency, hierarchical self-consistency, and global selfconsistency in aspects of clarifying legal relationships, establishing industry standards, improving the effectiveness of grassroots organizations, and clarifying hierarchical legislation, etc.
